Police officers could not give me warning under the Miranda rules (The Miranda rule where after your arrest and interrogation by the police when you say anything you tell to police that can be considered as proof.) What should I do?
If police could not warn you with Miranda rules than your can could not automatically dismissed. It is more important for you to wait till the police needs to give proper warning to gives notice and arrest you. Under the new law the police must have to give warning and arrest the person if he/she break the rules otherwise the state provides implied consent law to provide the legal rights to get the blood test to be done by the police. If you refuse to give the test than the police suspend your driving license.
I have suspected by the police and getting chemical test and they are positive. Please tell me why police applied me under the driving under influence (DUI) and also drag me under the Drive while Intoxicated (DWI)?
Both the rules are applied to the person with the person having drunken while you are driving the car. As per the new norms of the alcohol in the blood is in the range of .08 in all forty nine states so the as per new rules all the state enacted the both the law to curb the drunken driving.
